There is a two year window of opportunity for families to make outright gifts of assets up to $5M per individual ($10M per couple) directly to a beneficiary or in trust. This means a significant amount of family wealth can be permanently transferred out of the purview of the transfer tax system forever — before the scheduled return of the estate tax in 2013 at the $1M estate tax exemption level and the 55% estate tax rate. 2010 Tax Act & Planning Opportunities with Larry Brody, January 20, 2011, Advanced Markets Radio

Join us today as we re-air the broadcast between Larry Brody, Partner, Bryan Cave LLP and Randy Zipse, VP and Senior Counsel, Advanced Markets Group, who discuss the Obama-GOP Tax Cut Compromise Bill recently signed by President Obama and offer their thoughts on the interesting planning opportunities that may come of it. Larry and Randy emphasize that this is a "repeal of the repeal of the estate tax" and is set to last for only two years. Therefore, we may see planners taking advantage of the short term availability of the $5M exemption amount for Gift, Estate and GST taxes, and leveraging the exemption with life insurance before it sunsets to $1M at the end of 2012. We may also see more Dynasty Trusts created in the next two years to shelter family money from the transfer tax system before the two year window closes.  Further, if a trust's underlying transaction, such as old split dollar plans and loan arrangements, still makes sense, we may see planners tightening up trusts and using the increased exemption amount to make existing trusts more efficient.
